Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and WorkoTime ("WorkoTime", "we", "us") governing your access to and use of the WorkoTime platform, website, and mobile applications (collectively, the "Service").

By accessing or using our Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Service.

1. Description of Service

WorkoTime provides a cloud-based workforce management platform including AI face attendance, biometric device integration, GPS geofencing, leave management, and payroll automation with Indian statutory compliance (PF, ESI, TDS). Features available to you depend on your selected subscription plan.

2. Account Registration & Responsibilities

  • You must provide accurate and complete registration information and keep it updated.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorised use of your account at contact@workotime.com.
  • Accounts may only be used by the registered entity. Sub-licensing or resale of the Service is not permitted without our written consent.

3. Subscription, Fees & Billing

3.1 Plans and Pricing

WorkoTime is offered on a monthly subscription basis. Current pricing is listed on our Pricing page. We reserve the right to change pricing with 30 days' notice to registered account holders.

3.2 Free Trial

We offer a 14-day free trial with full platform access. No credit card is required to start. At the end of the trial, your account will be deactivated unless you subscribe to a paid plan.

3.3 Payment

Subscriptions are billed monthly in advance. Payments are processed securely through our payment gateway partners. All prices are in Indian Rupees (INR) and exclusive of applicable taxes (GST).

3.4 Refunds

Subscription fees are non-refundable except where required by applicable Indian consumer protection law. If you cancel mid-cycle, you retain access until the end of the paid billing period.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of Indian law
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Upload or transmit malicious code, viruses, or harmful content
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Service to send unsolicited communications (spam)
  • Collect or harvest data from the Service without authorisation
  • Impersonate any person or entity
  • Use the Service in a way that disrupts or degrades performance for other users

5. Employee Data & Privacy

You are the data controller for your employees' personal data. WorkoTime acts as a data processor on your behalf. You are responsible for:

  • Obtaining all necessary consents from employees for data collection and processing, including biometric data
  • Informing employees about how their data is used
  • Complying with applicable Indian data protection laws

Our handling of data is governed by our Privacy Policy.

6. Intellectual Property

WorkoTime and all its components (software, design, logos, content) are the intellectual property of WorkoTime and are protected by Indian and international intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service during your subscription period. You do not acquire any ownership rights.

Your company data remains your property. We do not claim ownership over your data.

7. Service Availability & Uptime

We aim to maintain a minimum 99.5% uptime for the WorkoTime platform (excluding scheduled maintenance). Enterprise customers receive an SLA with financial remedies for downtime. We will provide advance notice of planned maintenance where possible.

We are not liable for downtime caused by third-party services, internet outages, or force majeure events.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • WorkoTime's total liability to you for any claims arising from these Terms or use of the Service shall not exceed the amount paid by you in the 3 months preceding the claim.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
  • We are not liable for errors in statutory calculations resulting from incorrect data provided by you.

9. Indemnification

You agree to indemnify, defend, and hold harmless WorkoTime, its officers, directors, and employees from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

Either party may terminate the subscription at any time:

  • By you: Cancel from your account settings. Access continues until the end of the current billing period.
  • By us: We may suspend or terminate your account immediately for material breach of these Terms, non-payment, or activities that harm other users or the platform.

Upon termination, you may export your data within 30 days. After 90 days, data is permanently deleted.

11. Modifications to Terms

We may update these Terms periodically. Material changes will be communicated via email to registered administrators at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in India.
